I only glanced through the last few pages of the Kickback thread but dear Lard; there's a comically large number of them still believe that if they don't get the result they want from arbitration, then they can "just take it back to court" as if that is an automatic next step. A few posters are reminding them that they need to be able to show that arbitration didn't follow correct legal procedure if they want to do that, but they're just ignored.

It already does go back to court automatically after the arbitration verdict - the court case has been suspended, pending arbitration, but is still technically ongoing. The court will just rubberstamp the arbitration verdict, though, unless one of the parties brings up an issue about the correct legal procedures.

If they come to a decision too quickly they can appeal they had already made up their minds.

Ah, OK. I hadn't realised going back to court was automatic. Re your second point though; I get the impression the legal experts on KIckback are convinced they'll be able to just keep taking it to court until they reach the House of Lords and from there, the Council of Europe.

I'm hoping it does go back to court, with the cameras on. Lord Clark left enough room for the SFA sanction for breaking the rule against taking it to court in the first place to be appealed. This would be after they lose the current case and have to pay all the costs of course.

I can't understand the depth of pessimism being displayed by the intelligentsia on Kickback.

Didn't all parties involved in the arbitration process agree last week to call a halt and pay Hearts £5 million ? Surely true, it was reported on Kickback. And wasn't there agreement on Kickback that this should be rejected because the full £8 million was as good as in the bag already ?

I'm so confused.

There has been a real change in the level of optimism today for some reason, can’t see any evidence to suggest anything new.  It really has gone from pressing the nuclear button, burning Scottish football down, diddy clubs going out of existence, 10 million in compensation, a watertight win against the corrupt establishment. To we’re going to lose, be in the Championship, and receive next to no compensation. I wonder if all the legal eagles on there may not have been as on the ball as they thought ?

Isn't that them just getting to the end of the five stages of grief - Denial, Anger, Bargaining, Depression, and Acceptance?
