I've read Lord Clark's opinion again and, although he makes reference to the severity of the penalties, I'm not 100% clear on that. The reference to the severity of the penalties is in parenthesis. 

"On the advice of responsible counsel, Hearts and Partick Thistle brought these proceeding in court alleging unfair prejudice on that and several other grounds. In my opinion, questions may arise as to whether in that context a bar on raising legal proceedings without the permission of the Board of the SFA, subjecting a club to potentially extreme sanctions..., can be viewed as contrary to public policy and hence unlawful."

In any case, being contractually obliged to go to arbitration and being punished for not doing so initially are two different things.

Would the SFA panel have insisted ALL panel members were corporate law specialists with lots of experience, would documents have been released in a timely way without Lord Clark's threat to take it back to court, and would they have committed to doing it in a timely way without Lord Clark's insistence it happened quickly? And would we have had any chance of a public hearing without going to court first, albeit it seems that was never on the cards it arbitration was always the venue for this?

Personally I think an interdict would just make things even worse not better. But if Hearts decide to go down this route then so be it.

It's Partick Thistle- being taken along for the ride, in too deep now to get out- that I feel sorry for in all this.

It will be a wee shame when Hearts drop them like a Bosnian's pension fund.

Agree completely. We do seem to be getting backed into a corner though.

As I say there was always a fairer solution.

I hope we stick with it now, even an interdict or maybe court of arbitration for sport, or does the SFA have a rule against standing up for yourselves there too?

Worst that can happen for Hearts is a fine we'll be able to pay and a year or three more in the lower leagues. It's honestly PT that everyone is fucking over the most here, especially given their game in hand. Total disgrace and completely avoidable if the football community had stuck together from the start like other industries - and indeed other football leagues - have done.

I can't imagine the SFA actually dishing out any sort of major punishment for these two clubs. They have quite clearly broken the rule, but I'd expect them to just be censured for it as long as they don't attempt to go back to the courts and drag the whole thing out.

They've already had a very embarrassing public dressing down in the courts from Lord Clark, I reckon that is probably punishment enough.
