League Reconstruction 20/21 season

Recommended Posts

The SFA rules are strict and there for good reason. Going to court means more legal costs for everone; causes delays and with potential appeals can cause havoc. Arbitration by neutrals minimises costs, obtains a quick result and there is no appeal. All clubs signed up to that agreement.

Expulsion is the only fair outcome.

Is there a "standard" punishment for such an offence. What are you basing that on?

the Published SFA Judicial Panel Protocol sets out the normal range of fines for each offence.  In this case £500 for a lower end offence, £2500 for mid range and £5000 for upper end.  It does allow for a max of £500k but fines in normal situations usually are in the low to high end range.  They might go £10k given the seriousness here but wouldn’t be surprised to see normal range applied

Their entire case was laughable, and they clearly didn't have a leg to stand on. However, I'd defend their right to stand up for their interests, in the courts if required, and if they're happy to run the risk of being stuck paying costs.

I really don't think any further punishment would be appropriate*.

Further? They haven't had any punishment yet. The award of costs is not a punishment.

They certainly have the "right to stand up for their interests", There was a mechanism for them to do so, and to which they'd agreed, but chose to ignore. So punishment is entirely appropriate and well-deserved.

Permanent expulsion would be a bit harsh.

Suspension of their SFA membership for 2 seasons, one of which suspended.

Good old SFA. what a way to deter teams from breaking the rules, fine them a sum that most fans could stump up.

It was a 'no lasting harm done' offence, it already cost the two clubs a five-figure sum in legal costs, and it does set the precedent that this behaviour will be punished, with the possibility of bigger punishments for subsequent repetitions. There's also the warning from Lord Clark that the rule could possibly have been illegal if the punishment was too severe, so they were probably wise not to chance it.

Slap on the wrist it is. A nice wee twist of the knife to round off the summer's humiliation.

It won't be anything other than a slap on the wrists, unfortunately.

Yep. Needed to do something, but lenient as they could possibly be.

£25k seemed reasonable to me, they tried to stop the fucking league going ahead and bankrupt smaller clubs, £2.5k is f**k all to either club.

No they didn't. There was no attempt to halt or postpone the league in the petition to the Court of Session. Delaying the league and bankrupting smaller clubs wa maybe on the wishlist of the JKB moonhowlers, but it didn't form part of the arbitration.
