Once you've gone to binding arbitration it's a lot harder to challenge the decision, as you're really challenging the arbitration process itself rather than the original decision.

That's kind of the point of arbitration: to take it out of the hands of the courts by offering an arm's length process that encourages either settlement or a compromise that the courts then won't touch.

Wait we are going to get even more SCENES

While English is painting disclosure of documents as a victory for Hearts it also means that Hearts compensation claim is going to be public. I assumed with arbitration we wouldn't get to see the details of £8m in compo but it looks like we do.

My understanding is that it requires the SPFL to make all documents relating to the curtailment vote available to the arbitration panel. This may include internal SPFL emails and/or recorded video calls.

It was the opposite - it was clubs who were denied promotion after the Dutch authorities scrapped relegation from the Eredivisie against the will of the clubs. In other words, the Dutch equivalents of Dundee United were not promoted and were compensated as a result.

Nope. This was just a preliminary ruling, not a ruling on the issues (except that it's not getting binned early). There's arbitration first. Season ain't begun until the lawsuits is done!

He also said that some of the SFA's rules were doubtful in law, like being able to expel Hearts as a member or fine them £1million, so dismissing the case would require a full debate in court which the hearing was not intended for.

Could Hearts/Thistle come up with a plan to delay the arbitration long enough therefore making it go back to court?...wouldn't put it past them

The judge already awarded costs to the SPFL. If Hearts and Thistle were wondering where the judge was leaning he made it very clear imo.

Believe it or not, each side will choose an arbiter from a list.  Then those that have been chosen, choose another arbiter from the list to act as referee :)

Hearts (And Tom English naturally) need to paint this as some sort of even slight victory to avoid complete humiliation. Much preferable that to showing absolutely any ounce of humility.

Their victory is tantamount to Livi getting some points on the board in their season under Paul Lambert. But they still went down with a record low points total anyway.

No we won't. It's disclosure "to the tribunal", not to P & B.
