Parking fines

Another letter from them today saying they are surprised at me ignoring their previous letter and that they are passing this to their solicitors.
assume this is standard pish.
Yup. You'll then get a hilarious threat to have the "bailiffs" visit and other empty nonsense.

You'll get a new one every year or so when one bunch of these gimps sells your debt on to another.

*Presuming you live in Scotland. Bailiffs and County Courts are English legal terms of course.

Best to have zero contact with them, acknowledging that they exist gets them frisky and they do occasionally pick someone to take to court to encourage others to pay.

The second second bit is completely wrong. There is no criminal offence of trespass in Scotland but there is a delict of trespass.

Private organisations can and do set contracts for parking on private land and the courts enforce these contracts. 

Nobody can impose a contract on anybody but you can enter into a contract through your actions.

I actually succeeded with an appeal on one of these at the first attempt. They'd photographic evidence of me entering the Range car park at 18.30 on a Thursday and leaving at 13.30 on the Friday and thus exceeding the two hour maximum. 

I just explained that these were two separate visits.

 Kind of feel like i shouldn't have even bothered doing that much but on the other hand i'm not worrying about it now.

Not a parking fine question but this seems as good a thread as any.

Car was broken into while in a private car park on Tuesday/Wednesday with three windows smashed, a couple of bags taken and our belongings chucked all over the ground. Usual signs up about car park owners have no liability etc so no chance of claiming anything off them.

There are signs up (that I've taken photos of) saying the car park is monitored by CCTV - but when my wife emailed them asking about the footage she was told the car park isn't covered by CCTV, despite them claiming otherwise.

Given they've lied and I wouldn't have parked there if I'd known there were no cameras, is there anything I can do? I've reported them to trading standards for all the difference that will make, but would be nice if there was a chance of claiming back some of the cost of my new windows. I've tried Googling but everything is more focussed towards parking fines etc.

I wouldn't have thought so. You might have decided for yourself that the provision of CCTV was a service being provided and formed part of your contract but I don't see any way of you being able to evidence that the operator also believed that this was an integral part of the contract. 

Even if there was they wouldn't have a duty of care to keep your car and belongings safe. Their duty is to provide a place to leave your car unless specifically stated that you were also paying for the safety and security of your car and belongings.

It would be interesting if there were the usual "Car park monitored by CCTV, illegal parking will be fined" signs as if the car park is not actually monitored by CCTV and folk were receiving demands for money for parking there would that not be rather iffy?
