This has always been the case regarding spreading out the cap hit and is why the Saints found themselves with no option that to start releasing players. What Washington did was try to completely circumvent the cap by paying out large amounts of future contract value in the un-capped year. These behaviours are not analogeous - in Washington's case they actually removed the 36m of cap completely after multiple warnings from the NFL that they would be punished. Burden of proof is less, and sadly with sexual assault cases it is the closest a lot of victims can get to justice.
