As I merged on to a dual carriageway from the slip road someone pulled out to let me out. When I pulled out they were still behind me so I accelerated to get up to speed. I was given a major because I supposedly should have held my speed and let him merge back in front of me.

Sure you weren't keeping pace with him and then overtaking on the inside lane to get up to speed? Easily done.

If you pick up 3 minors in the same category that counts as a major fault.

There's no fixed number: you can get 5 or 6 in the same category and still pass. The criterion is whether (in the examiner's opinion) the fault is habitual.
