  1. League Reconstruction 20/21 season Booted out at the committee stage and never got off the ground when SuperBudge was going to revolutionise Scottish Football. Would only have happened if it had been included in the original SPFL Resolution to end the leagues. The fear has to be as the current situation unfolds that it may require to be revisited, especially for the lower leagues, as most clubs will not be able to play with no paying fans. Don’t see crowds at Sporting events for some time to come, especially given recent events in Aberdeen.
  2. THE JAMBO POET This sort of nonsense has been stoked by the club Statement as written by AB, she should no better than refer to recent events as a battle and winning “the WAR”. She needs to rain it in ASAP, the only saving grace is 99% of this bluster is keyboard warriors. As for a War she should have visited the local Hospital ITU unit a few weeks ago and then she would have seen a battlefield of a different sort.
  3. I believe that most Hearts fans will accept the outcome and move on, myself included. When fans are allowed back to matches they will go home and away regardless of what is said on JKB. As there always has been, there will be anger towards the SPFL & SFA, nothing new there as most feel regardless of all the recent events that they are poorly run/administered and favour two clubs. The reality for us Hearts fans is there were very poor decisions made by those in charge at HMFC, with regards to Managers/Coaches and signing of players. Would we have avoided finishing bottom if the season had concluded naturally, probably not in my opinion, as we were terrible against bottom half sides with a Manager who was out of his depth and no better than the one he replaced. There have been some positives for us in recent weeks with the signing of RN, JJ and CG. Add in promises of financial assistance and we will move forward in a reasonable position all things considered. Hopefully the relegation clauses in players contracts are severe to the point a number choose to move on (should anyone want them). Now simply looking forward to the day that I can sit next to (or near) my mates, have a beer before and after the game and watch some live football.
  4. Yes. It’s been a good way to pass the time when at Tynecastle over the last few seasons Hopefully they will make face coverings mandatory when we get back to games and I can shout what I like at our quality, hard working players, safe in the knowledge I can’t be identified by the Budgie Polis

  7. Given there has been no announcement, that I am aware of, that the Arbitration panel has been selected is it possible that no one on the list wants to make themselves available? And if so who would blame them!
  8. Thank you for taking the time to comment on my post, the Arbitration process has been widely reported in recent days but your pertinent and helpful summary is appreciated. Perhaps I may suggest that you are a little more accurate when quoting and at least make sure it is from the same post (“handed down by Lord Clark”) or you also may be referred to as a fucking dipshit.
  9. I’m sure a lot of people would be delighted if the only thing they had to worry about in recent months was this charade. My main point is it could all so easily have been avoided. From a football perspective for myself it has at least meant the departure of Daniel Stendel and a number of players and back room staff that won’t be missed. Some massive mistakes been made at Tynecastle throughout the League season, that had they been made by a rival then yes I’d also be having a good laugh at also, fair play.
  10. Lord Clark rejected the SPFL premise that persons with footballing interest should preside over this matter. Instead, it would be an independent (from the SFA or SPFL) tribunal. While Hearts and Partick Thistle were unable to get the hearings in open court as they wanted, they got their way in their request for documents to be uncovered relating to the case before it is heard by a tribunal.

Why did they contest the request for documents to be released then. “In these unprecedented circumstances, it is, in my view, open to me under the inherent jurisdiction of the court, to make an order for the recovery of documents. I do not accept the contention of [the respondents] that granting such an order is not competent; the issue is before the court. I have had full regard to the points made on behalf of those parties in opposition to the motion for Hearts and Partick Thistle for recovery of documents.”
  12. At the Court of Session hearing, Lord Clark ruled in favour of Hearts and Partick Thistle's motion to release certain documents relating to the case. The clubs have succeeded in their petition for the recovery of documents relevant to orders they sought in terms of the Companies Act 2006. He noted that, by default, rule 28 of the Scottish Arbitration Rules allowed an arbitration tribunal to grant disclosure of documents, but that this rule could be excluded by the parties. Putting all that aside the point I was making is that Scottish Football didn’t need to be in this position.
  13. Reconstruction could and should have been part of the Resolution presented by ND and the SPFL Board to end the League’s. It could have been in the simple form of 12, 12, 10, 10 if only the lower leagues were ended and 14,10,10, 10 if all leagues were ended. Could easily added that any other format, that was agreed by the members, which For example didn’t see a Club playing in a lower league From 19/20 Season could be used instead. What was presented and the way it was then handled can only be described as farce. 13 clubs, more than 30% of all teams represented by the SPFL - expressed serious doubts in the executive and wanted an inquiry into their actions. The continual dangling of the reconstruction carrot to the clubs worse affected was most probably nothing more than a delaying tactic to try and avoid them following through with the threat of Legal action. Had Hearts and Partick gone straight to the SFA for arbitration then the legal requirement for all related documents to be made available would not have been in place, clearly something their Legal Teams feel are very important. All Clubs had the opportunity to put their preferences on reconstruction to the committee that was initially set up. We will soon find out what the final outcome is but regardless the damage done could so easily have been avoided.

I was making the point that whilst multiple clubs are blaming each other - “Doncaster, nobody seems to be laying the blame at his door yet the farcical resolution forced through by him and his SPFL Board is the reason Scottish Professional Football is in this mess. “ Wasn’t having a go at any other clubs specifically, don’t agree with most of the sentiment on JKB at present but can see how the strength of feeling there has got to this point. The SPFL clubs pay ND in excess of £7k per week and should be expecting a whole lot more than he has delivered. As for me making racial remarks? Not aware that I had and certainly never purposely did so. Whatever the outcome of Arbitration the game as a whole has a very challenging period ahead as does the whole of society, how well and how quickly Scottish Football heals these wounds could prove critical.
