As much as you would like to, you can't just ignore history. Sorry.
And you aren't seriously asking the difference between insulting someone for being black and for being Scottish are you? Because that would be monumentally stupid.
Here's the FA rule: E3(2)
"
In the event of any breach of Rule E3(1) including a reference to any one or more of a person's ethnic origin, colour, race, nationality, faith, gender, sexual orientation or disability (an "aggravating factor"), a Regulatory Commission shall consider the imposition of an increased sanction,"
So Deky's offended Scotsman could take his case through the same process. The FA report on Suarez-Evra could be understood to support him in doing so, based on the discussion about subjectivity and objectivity. It doesn't say they will consider all insults equally, which is your point, but if a case came up now, they'd look pretty hypocritical if they ignored their own rule. 2 game suspension as the entry point for the breach of E3(1), doubled to 4 for the breach of E3(2). Over the top for some ("you'd get less for kicking him") and to others, a quick way to clamp down on immature disrespectful behaviour.
