I heard this on the BBC 3 news last night, it's prett funny considering one of my mates has his xbox chipped. He's actually hasn't said anything about it yet.

I know a few folk who have been banned, obviously MS won't say how they're detecting people but it seems to be those who have been playing Wave 4 games and those who have been playing games before they're released.

EDIT: MS always seem to do a banning wave in November... could it be because of those people who are banned most will then go out and purchase a new Xbox 360 for Christmas?

It's the console that is banned, not the account - a person can buy a new Xbox and then sign into Xbox Live again with no problems.

To be honest, that's one of the main reasons why Microsoft don't have the threat of banning the Gamertag - as then people won't buy replacements.

If you're interested, one of my mates is selling their banned Elite console for £70 I think

And, the banhammer gets swung my way. Made the schoolboy error of signing in.

Crazy thing was, I didn't even play anything online, there wasn't even a disc in my 360, I stealthed MW2 the other day and it came up clean but apparently Microsoft can find ways around the video files now even after you've played the game and removed the disc.

Ah well not too fussed, I wasn't big Live player anyhoo, at least I can play what i like, when i like now! Assassins Creed 2 is getting downloaded as of now.

A wee bit peeved at myself though to be fair, I resolved not to play any wave 4 games until the new ixtreme came out and I broke that resolution as the drag of Modern Warfare 2 was too great. In the end, it didn't matter when I signed back into Live, even if it was a month from now, they'd have still clocked it and banned my sorry arse anyway.

Ah well, got a good 6 months out of it.

Could you not take your HDD to another person's xBox and use theirs to get access to your account since it's only the computer that is banned?

My subs ran out on the 26th October and I have not renewed yet. I think I have only played lips since then and thats an original disc.

I think I will just buy a month to see if I am banned.

I wont be to bothered either as I dont play online that much either, although the wife does download songs for lips. Oops!

After reading into it a wee bit, it seems that they are now able to detect any firmware modifications regardless of when and what version, the Wave 4 thing isn't the main cause of the bannings, it's the very fact that they can now detect just about all modified consoles.
